1. About MyKidsCoach

MyKidsCoach (“we”, “us”, “our”) is an AI-powered coaching plan platform operated by James Sycamore (ABN:[68 995 595 744]) based in Victoria, Australia. Our platform is available at mykidscoach.com.au.

By creating an account or using our services, you agree to these Terms of Service. If you do not agree, please do not use our platform.

2. The Service

MyKidsCoach provides AI-generated training and coaching plans for youth sports. Plans are created using artificial intelligence and are intended as a guide only. They do not constitute professional sports coaching advice.

We provide the service with due care and skill, however we do not guarantee that plans will be suitable for every individual child’s specific needs, physical condition, or circumstances. Plans are AI-generated general guidance only and are not a substitute for qualified coaching judgement, medical advice, or your club’s safety and risk management procedures.

Coaches and parents remain solely responsible for assessing whether a plan is appropriate for their group, supervising sessions, checking the playing environment and equipment, and responding to any injury, illness, or incident that occurs during training. MyKidsCoach accepts no liability for injuries arising from the use of plans generated through the platform, except as required by the Australian Consumer Law.

3. Subscriptions and Payments

MyKidsCoach offers both free and paid subscription plans. Paid plans are billed on a monthly or annual basis via Stripe. All prices are in Australian Dollars (AUD) and include GST where applicable.

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings.

We reserve the right to change our pricing with 30 days notice. Existing subscribers will be notified by email before any price change takes effect.

4. Refunds

Under the Australian Consumer Law, you may be entitled to a remedy if our service fails to meet a consumer guarantee. If you believe you are entitled to a refund, please contact us at hello@mykidscoach.com.au.

Outside of your statutory rights under the Australian Consumer Law, subscription fees are generally non-refundable for the current billing period. We will consider refund requests on a case-by-case basis.

5. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality.

6. Your Account

You are responsible for maintaining the security of your account and password. You must notify us immediately of any unauthorised use of your account. You must be 18 years or older to create an account.

7. Acceptable Use

You agree to use MyKidsCoach only for lawful purposes. You must not share your account with others, resell access to our platform, or use our content for commercial purposes without our written permission.

8. Intellectual Property

All content on MyKidsCoach, including AI-generated plans, is owned by or licensed to MyKidsCoach. You may use plans for personal coaching purposes but may not reproduce, distribute, or sell them without our written permission.

9. Privacy

We collect and handle personal information in accordance with the Australian Privacy Act 1988. We do not sell your personal data to third parties. For full details, please see our Privacy Policy.

10. Limitation of Liability

To the extent permitted by law, MyKidsCoach’s liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages. Nothing in these terms limits your rights under the Australian Consumer Law.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes by email. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
